1. O que é este serviço

Este site permite que pessoas inscritas no canal FunkyBlackCat no YouTube (o "Streamer") enviem uma mensagem de texto ou uma gravação de voz, que é convertida em áudio e exibida como um alerta ao vivo na transmissão do Streamer. O uso é gratuito e não envolve pagamento.

Ao usar o serviço, você concorda com estes Termos e com a Política de Privacidade. Se não concordar, não use o serviço.

2. Quem pode usar

• Você deve ter pelo menos 18 anos.
• Você deve ter se inscrito no canal do Streamer no YouTube. O Streamer pode exigir um tempo mínimo de inscrição; atualmente não há essa exigência.
• Você deve usar a sua própria conta Google no login. Não é permitido usar a conta de outra pessoa.

3. Regras de conteúdo

Ao enviar uma mensagem, você se compromete a não incluir:

• conteúdo ilegal, ou que incite ou facilite atividade ilegal;
• discurso de ódio, discriminação, assédio, ameaça ou incitação à violência;
• conteúdo sexual, especialmente envolvendo menores, ou sexualmente explícito;
• dados pessoais de terceiros (endereço, telefone, documentos) — inclusive exposição não consentida ("doxxing");
• difamação, calúnia ou injúria contra qualquer pessoa;
• spam, propaganda não autorizada, links maliciosos ou golpes.

As vozes disponíveis são estilizações sonoras oferecidas apenas para fins de entretenimento no contexto da transmissão. Você não deve usá-las para enganar terceiros quanto à autoria ou origem da mensagem.

4. Moderação

O Streamer pode, a seu critério e a qualquer momento, deixar de exibir, interromper, editar ou remover qualquer mensagem, bem como bloquear o acesso de qualquer pessoa ao serviço, sem aviso prévio e sem qualquer obrigação de compensação. Não há garantia de que uma mensagem enviada será exibida.

5. Exibição ao vivo e gravações

Você entende e concorda que o alerta gerado — incluindo o nome do seu canal no YouTube e o áudio resultante da sua mensagem — será exibido publicamente durante uma transmissão ao vivo e poderá permanecer em gravações (VODs), cortes, compilações e republicações.

Se você usar o botão "Mostrar no chat da live", o nome do seu canal e a data em que você se inscreveu no canal são publicados no chat público da transmissão, pelo bot da StreamElements, e podem permanecer no replay do chat da gravação. Isso só acontece a seu pedido.

Você concede ao Streamer uma licença gratuita, não exclusiva, mundial e pelo prazo necessário à finalidade, para usar o áudio gerado a partir da sua mensagem, incluindo: exibir em transmissões ao vivo; manter e reexibir em VODs; usar em cortes, compilações, reprises e em vídeos curtos (Shorts, Reels, TikTok e semelhantes); usar na divulgação e promoção do canal, inclusive em conteúdo monetizado; publicar em plataformas de terceiros; fazer edição técnica do áudio (corte, volume, normalização); e armazenar de forma temporária ou permanente enquanto for útil a essas finalidades.

Essa licença é concedida apenas ao Streamer e para os fins de divulgação do canal e das transmissões. Ela não é uma autorização para que terceiros usem o seu áudio fora do que decorra naturalmente da divulgação pública das transmissões. Republicações independentes feitas por terceiros (cortes de canais de terceiros, reuploads etc.) estão fora do controle do Streamer.

6. Seus direitos sobre a mensagem

Você declara que a mensagem enviada é sua ou que você tem os direitos necessários para enviá-la. Você continua titular do conteúdo que criou; a licença da seção 5 existe apenas para viabilizar o funcionamento do serviço.

O consentimento para o tratamento dos seus dados (descrito na Política de Privacidade) e a licença de uso do áudio da seção 5 são coisas distintas. Você pode retirar o consentimento a qualquer momento: isso produz efeitos para tratamentos futuros e leva à exclusão dos dados guardados quando a exclusão for juridicamente exigível. A retirada do consentimento não desfaz automaticamente a exibição pública já realizada de forma lícita antes da retirada (por exemplo, um trecho que já foi ao ar numa transmissão e ficou no VOD), nem alcança cópias que estejam fora do controle do Streamer. O Streamer deixará de fazer novos usos do áudio a partir do pedido e removerá, quando possível, as cópias sob seu controle direto.

7. Serviço "como está"

O serviço é oferecido no estado em que se encontra, sem garantia de disponibilidade contínua, ausência de erros ou de que atenderá a uma finalidade específica. O serviço pode ser suspenso, alterado ou descontinuado a qualquer momento.

8. Limitação de responsabilidade

Na máxima extensão permitida pela lei, o Streamer não responde por danos indiretos, lucros cessantes ou danos decorrentes de: indisponibilidade do serviço; conteúdo enviado por quem usa o serviço; uso indevido do serviço por terceiros; ou falhas de serviços de terceiros (como Google, ElevenLabs e o provedor de hospedagem). Nada nestes Termos afasta responsabilidades que a lei não permita afastar, especialmente perante o Código de Defesa do Consumidor.

9. Uso de serviços de terceiros

O serviço depende de ferramentas de terceiros. O login usa o Google; a geração de áudio usa a ElevenLabs, o que implica transferência do conteúdo da sua mensagem para os Estados Unidos. Ao usar o serviço, você também se submete aos termos dessas plataformas, no que se aplicar.

10. Alterações nestes Termos

Podemos alterar estes Termos. A data no topo da página será atualizada. O uso do serviço após uma alteração significa concordância com a versão vigente.

11. Lei aplicável e foro

Estes Termos são regidos pela lei brasileira. Fica eleito o foro do seu domicílio para dirimir eventuais controvérsias, sem prejuízo de outro foro assegurado por lei.

1. What this service is

This site lets subscribers of the FunkyBlackCat YouTube channel (the "Streamer") send a text message or a voice recording, which is converted into audio and shown as a live alert on the Streamer's broadcast. Use is free and involves no payment.

By using the service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

2. Who may use it

• You must be at least 18 years old.
• You must be subscribed to the Streamer's YouTube channel. The Streamer may require a minimum subscription time; there is currently no such requirement.
• You must use your own Google account to sign in. Using someone else's account is not allowed.

3. Content rules

By sending a message, you undertake not to include:

• content that is illegal, or that incites or facilitates illegal activity;
• hate speech, discrimination, harassment, threats, or incitement to violence;
• sexual content, especially involving minors, or sexually explicit content;
• third parties' personal data (address, phone number, documents) — including non-consensual exposure ("doxxing");
• defamation, slander, or insult against any person;
• spam, unauthorized advertising, malicious links, or scams.

The available voices are sound stylizations offered solely for entertainment purposes in the context of the broadcast. You must not use them to mislead others as to the authorship or origin of the message.

4. Moderation

The Streamer may, at their discretion and at any time, stop showing, interrupt, edit, or remove any message, as well as block a user's access to the service, without prior notice and without any obligation to compensate. There is no guarantee that a submitted message will be shown.

5. Live display and recordings

You understand and agree that the generated alert — including the name of your YouTube channel and the resulting audio of your message — will be displayed publicly during a live broadcast and may remain in recordings (VODs), clips, compilations, and re-uploads.

If you use the "Show in the live chat" button, your channel name and the date you subscribed to the channel are posted in the broadcast's public chat by the StreamElements bot, and may remain in the chat replay of the recording. This only happens at your request.

You grant the Streamer a free, non-exclusive, worldwide license, for the time necessary for the purpose, to use the audio generated from your message, including: showing it in live broadcasts; keeping and re-showing it in VODs; using it in clips, compilations, reruns, and short videos (Shorts, Reels, TikTok, and the like); using it to publicize and promote the channel, including in monetized content; publishing it on third-party platforms; performing technical editing of the audio (trimming, volume, normalization); and storing it temporarily or permanently for as long as it is useful for those purposes.

This license is granted only to the Streamer and for the purposes of promoting the channel and the broadcasts. It is not an authorization for third parties to use your audio beyond what naturally follows from the public dissemination of the broadcasts. Independent re-uploads by third parties (clips on third-party channels, reuploads, etc.) are outside the Streamer's control.

6. Your rights over the message

You declare that the message you send is yours or that you have the rights necessary to send it. You remain the holder of the content you created; the license in section 5 exists only to make the service work.

Consent to the processing of your data (described in the Privacy Policy) and the license to use the audio in section 5 are separate things. You may withdraw consent at any time: this takes effect for future processing and leads to deletion of stored data when deletion is legally required. Withdrawing consent does not automatically undo public display that already lawfully took place before the withdrawal (for example, a segment that already aired in a broadcast and stayed in the VOD), nor does it reach copies that are outside the Streamer's control. The Streamer will stop making new uses of the audio from the date of the request and will remove, where possible, the copies under their direct control.

7. Service "as is"

The service is provided as is, with no guarantee of continuous availability, absence of errors, or fitness for a particular purpose. The service may be suspended, changed, or discontinued at any time.

8. Limitation of liability

To the maximum extent permitted by law, the Streamer is not liable for indirect damages, lost profits, or damages arising from: unavailability of the service; content submitted by users; misuse of the service by third parties; or failures of third-party services (such as Google, ElevenLabs, and the hosting provider). Nothing in these Terms excludes liabilities that the law does not allow to be excluded, in particular under the Brazilian Consumer Protection Code.

9. Use of third-party services

The service depends on third-party tools. Sign-in uses Google; audio generation uses ElevenLabs, which involves transferring your message content to the United States. By using the service, you are also subject to the terms of those platforms, as applicable.

10. Changes to these Terms

We may change these Terms. The date at the top of the page will be updated. Using the service after a change means you agree to the version in force.

11. Governing law and venue

These Terms are governed by Brazilian law. The courts of the user's domicile are chosen to settle any disputes, without prejudice to any other venue guaranteed by law.
